USPTO Trademark Filing Fees In Denver, CO

The USPTO charges a standard trademark TM Fees Chartfiling fee of $350 per class of goods and services at the time of filing. However, in many cases, we can apply using the less expensive TEAS Plus application. The TEAS Plus filing fee is $250 per Class. Thomas P. The majority of trademark filings are filed under one class. For example, a trademark for a brand of coffee would be filed under Class 30, which is the class for staple foods such as:

Coffee, tea, cocoa, sugar, rice, tapioca, sago, artificial coffee; flour and preparations made from cereals, bread, pastry and confectionery, ices; honey, treacle; yeast, baking powder; salt, mustard; vinegar, sauces (condiments); spices; ice.

But, some trademarks are used on a wider range of goods or services and therefore must be registered in multiple Classes.

The USPTO provides an ID Manual that allows users to search for acceptable identifications of goods and services.

Intent-to-Use Applications

To register your trademark, you’ll need to provide evidence that you’re using it in commerce. To clarify, this means you’ll need to submit a specimen showing how you use your trademark. You’ll also need to provide the date you first used your trademark in commerce and the date you first used it anywhere.

If you are not using your trademark in commerce at the time we file your application, we will need to file a Statement of Use. A Statement of Use confirms that you are distributing your goods or services in connection with your trademark. The deadline for filing the Statement of Use is six months after the USPTO’s approves your application. Currently, the USPTO is taking about nine months to approve trademark applications. Thomas P. Howard, LLC charges a flat fee of $125 to prepare and file a statement of use. The USPTO charges a $100 fee per Class for the Statement of Use. We can request up to five extensions of time to file the Statement of Use.
